The minister can approach the district collector itself and present his contentions, the court said while dismissing the petition.
Chandy will reportedly also take up with the party national leadership the issue of moving the apex court seeking to expunge the adverse remarks made against him on Tuesday by the Kerala high court.
Amid increasing demands for the resignation of Transport Minister Thomas Chandy, who is facing encroachment charges, Kerala Chief Minister Pinarayi Vijayan on Tuesday said that an "appropriate decision" would be taken at the right time.
"It shows that you have no trust in your own government and chief minister", the bench said, observing it was "extremely improper" for a minister to file a petition against his own government.
"We can not disclose our decision to media", he told reporters. Vijayan said the LDF had earlier chose to entrust him to take an appropriate decision on the matter after looking into all aspects.
It is based on the principle of collective responsibility that the entire cabinet resigns even if a no-confidence motion is passed against a single minister, the court pointed out.

Chandy is the Nationalist Congress Party nominee in the LDF ministry.
The opposition Congress' agitation against Chandy lost some steam after its own Rajya Sabha MP and lawyer Vivek Tankha appeared for the minister in the high court.
